This privacy policy provides information about the processing of your personal data, both when you are a service recipient and when you visit the Facebook page named “BetterSoft”, administered by BetterSoft Sp. z o.o., with its registered office in Żory at ul. Rozwojowa 2, 44-240 Żory, Poland (the “Controller”).
This policy explains how your personal data is collected, used or otherwise processed, and how we fulfil our obligations towards you.

We make every effort to ensure that your data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (“GDPR”), as well as the applicable Polish personal data protection legislation.
We also protect the privacy of people using Facebook in accordance with GDPR requirements. We apply technical and organisational measures required by European Union law to protect personal data against unauthorised disclosure, unlawful processing, alteration, loss or destruction.
2. Purposes and legal grounds for processing
1. The Controller processes personal data in order to perform a concluded agreement (Article 6(1)(b) GDPR), answer questions, provide information about the offer and conduct correspondence while you use the Controller’s services.
2. The Controller also processes data in connection with operating the website www.bettersoft.pl and the Facebook account named “BetterSoft”, including ensuring security and preventing possible misuse in the Facebook comments section (Article 6(1)(f) GDPR). 3. The Controller processes data to establish and pursue claims, defend against claims and archive evidence where legally necessary to demonstrate facts (Article 6(1)(f) GDPR).
4. The Controller processes personal data to facilitate communication concerning meetings with contractors, both at the Controller’s registered office and elsewhere, including information about planned or cancelled meetings (Article 6(1)(f) GDPR).
3. Cookies
The Controller’s social media profile embedded in Facebook uses cookies originating from Facebook. The Controller has no influence over activities performed on the basis of those cookies and is not responsible for them. 4. Personal data retention period
The Controller retains personal data in a form that permits identification of the data subject for the duration of the applicable limitation period for claims.
5. Disclosure of data
Users’ personal data may be disclosed to entities processing personal data on behalf of the Controller under appropriate agreements, including in particular hosting service providers, as well as entities authorised to obtain personal data under applicable law.
6. Rights of data subjects
Persons whose data we process have the right to obtain confirmation from the Controller as to whether their personal data is being processed and how it is processed. Where personal data is processed, the data subject may request:
a) access to the data;
b) a copy of the data being processed, with the first copy provided free of charge and reasonable administrative costs potentially charged for additional copies (Article 15(3) GDPR);
c) rectification of inaccurate data and completion of incomplete data (Article 16 GDPR);
d) erasure of data where the Controller no longer has a legal basis for processing or the data is no longer necessary for the purposes of processing (Article 17 GDPR);
e) restriction of processing (Article 18 GDPR);
f) data portability (Article 20 GDPR);
g) objection, on grounds relating to the data subject’s particular situation, to processing based on the Controller’s legitimate interests under Article 6(1)(f) GDPR, including profiling. The Controller will assess whether compelling legitimate grounds for processing override the interests, rights and freedoms of the data subject, or whether processing is required for the establishment, exercise or defence of legal claims. If the data subject’s interests prevail, the Controller will cease processing for those purposes (Article 21 GDPR);
h) withdrawal of consent at any time without giving a reason. Processing carried out before consent was withdrawn remains lawful. Withdrawal of consent results in the Controller ceasing processing for the purpose for which the consent was given.

If you believe that your data is processed contrary to applicable law, you may lodge a complaint with the President of the Personal Data Protection Office in Poland:

7. Transfers outside the European Economic Area (EEA)
Your personal data will not be transferred to a third country or international organisation by the Controller.
When visiting our Facebook profile, data may be transferred outside the EEA by Facebook, using contractual clauses approved by the European Commission and adequacy decisions adopted by the European Commission for specific countries, in accordance with the rules applied by Meta Platforms Inc.
8. Changes to the privacy policy
This privacy policy may be supplemented or updated in line with the Controller’s current activities and needs in order to provide reliable information about the processing of personal data. Users will be informed of changes through the BetterSoft Facebook profile.
This privacy policy has been in force since 1 January 2025.
